COHABITATION BILL - AS AT 29TH MAY 09 - UPDATE

The Bill went to the House of Lords for the first part of the committee stage on the 30th April. This is when the House of Lords goes through the Bill line by line and discusses whether or not to approve the Bill or whether any amendments should be made. They only got through the first couple of sections at the first meeting and no date has yet been scheduled for the next meeting of the committee.

At the first meeting however there was much discussion about the early sections of the Bill including whether or not a two year co-habitation is the right period or whether it should be a longer period. There is talk for example that it may be for the period of co-habitation to be five years.

There is also some discussion about whether this is the way forward and whether or not the existing law is sufficient to protect co-habitees' rights particularly if there are children where there are other remedies available under the existing law.
